If an agency fails to be mostly compliant it will be denied. Only an agency is told why they were denied. After reading the documents myself, I feel there is *significant* wiggle room for agencies to be considered "mostly compliant". In fact many people believed there was far too much leniency written within the Hague and it would be insufficient to offer the protections the Hague was meant to offer.
